1.Who can use it

You must be at least 18 years old and legally able to enter into this agreement where you live. upvoted is not for anyone under 18.

You may not use upvoted if you are located in, resident of, or a citizen of the United Kingdom; France, including its overseas departments, regions and collectivities (Guadeloupe, Martinique, French Guiana, Réunion, Mayotte, Saint Pierre and Miquelon, Saint Barthélemy, Saint Martin, Wallis and Futuna, French Polynesia, New Caledonia, the French Southern Territories); Cuba, Iran, North Korea, Syria, Russia, Belarus, or the Crimea, Donetsk or Luhansk regions; or any other jurisdiction we restrict. You may not use it if you, or anyone you act for, is named on a sanctions list (including those of the United Nations, the European Union, the United Kingdom and the United States).

We block restricted regions at the network edge and screen wallet addresses against sanctions lists. You agree not to get around these measures with a VPN, proxy, relay or any other means. If you do, you are in breach of these terms and you use the interface entirely at your own risk and responsibility.

You are responsible for knowing and following the laws that apply to you, including laws on crypto-assets, securities, gambling, marketing, consumer protection and tax. upvoted makes no claim that it is lawful or appropriate to use in your jurisdiction.

2.What upvoted is, and is not

upvoted is software: a website that shows publicly available information about tokens on pump.fun, lets visitors vote on them, and helps you build Solana transactions that you sign in your own wallet. It includes a public Solana program ("the program") that can route the pump.fun creator fees of coins launched through the interface, as described on the "how it works" page.

upvoted is not an exchange, a trading venue, a broker, a dealer, a custodian, a bank, a payment service, a financial adviser, a portfolio manager or a crypto-asset service provider. We do not issue, list, sell, promote, vet or endorse any token. We never take custody of your funds or tokens, never execute orders for you and never act as a counterparty.

upvoted is not affiliated with, endorsed by or sponsored by pump.fun, reddit, Solana Labs, the Solana Foundation or any wallet provider. "reddit" is a trademark of its owner; upvoted only borrows the idea of a front page with votes.

3.Real transactions on Solana mainnet

upvoted works only with real assets on Solana mainnet. There is no demo, paper or test mode. Every transaction you sign spends or moves real SOL or real tokens.

Blockchain transactions are final and irreversible. Nobody, including us, can cancel, reverse, refund or recover a transaction, a mistaken amount, a wrong address or tokens sent to the wrong place.

Quotes, prices, market caps, charts and estimates shown by the interface are approximations that may be delayed, incomplete or wrong. The price you get is set by the pump.fun bonding curve (or the pool the coin trades in) when your transaction lands, within the slippage limit shown to you.

4.Your wallet

upvoted is non-custodial. Your wallet software shows you each transaction and you alone decide whether to sign it. We never ask for, receive or store your seed phrase or private keys. Anyone who asks you for them in our name is a scammer.

You are solely responsible for the security of your wallet, your device and your keys, and for every transaction signed with them. Check every transaction in your wallet before you sign it.

5.Fees and fee routing

upvoted charges no fee of its own. pump.fun charges its own trading and creation fees (set by pump.fun and subject to change), and the Solana network charges transaction fees and account rent. These are paid from your wallet as part of the transactions you sign.

When the program is live, a coin launched through upvoted has the program set as its pump.fun creator, so its creator fees are collected by the program and routed by the on-chain rule: to buy the coin back and burn it, or to a floor reserve that no one can withdraw, including us and you. The person who launches such a coin does not receive its creator fees. The floor reserve is not a deposit, a claim, a redemption right, a price support or anyone's obligation. Until the program is live, a launch through upvoted is a standard pump.fun launch and you are the coin's creator.

6.Launching a coin

Anyone can create a token. When you launch a coin through the interface, you are its creator and you alone are responsible for it: its name, ticker, image, description, links and any statement you make about it, and for complying with every law that applies to it and to you.

You must not launch coins that use another person's or organisation's name, likeness, logo or trademark without permission, that impersonate anyone, that are designed to deceive, that promise gains or describe the coin as a way to make money, or whose content is illegal, hateful, sexual involving minors, or infringing.

Coins and their content are published on pump.fun, on IPFS and on the Solana blockchain. They are public and permanent. We can hide a coin from the upvoted interface; we cannot remove it from pump.fun, IPFS or the blockchain.

7.Votes and rankings

The upvote and downvote arrows record anonymous opinions of visitors. Rankings, scores, flairs, phases and "hot", "top", "rising" or "controversial" lists are arithmetic on those votes and on public trade data. They are not recommendations, endorsements, ratings or predictions, and they can be wrong, coordinated or manipulated.

We may limit, discount, reset or remove votes, and change how rankings work, at any time and without notice, for example to fight spam or abuse. Votes are not property and give you no rights.

8.The $DOOT coin

The team behind upvoted may launch or has launched a memecoin called $DOOT. $DOOT is not tied to upvoted. It has no use, utility or function on this website: holding, buying or selling it gives no access, features, discounts, rewards, revenue or revenue share, votes, governance or any other right, on upvoted or anywhere else. It has no link to the votes, the rankings or the fee routing. Nothing on upvoted is gated by it.

$DOOT is not a financial product and is not offered as one. The team holds some of it and may sell all of it at any time, including shortly after launch or after posting about it. Its value can go to zero. Nothing we say about $DOOT is advice or a promise.

9.No advice

Nothing on upvoted, including its pages, posts, votes, rankings, charts, phases, flairs, estimates, announcements and social media, is financial, legal, tax or other advice, or an offer, solicitation or recommendation to buy, sell or hold anything. Do your own research and consult qualified professionals before making any decision.

10.Things you must not do

• break any law or regulation, or use the interface for money laundering, terrorist financing, sanctions evasion, fraud or scams
• manipulate markets, including wash trading, spoofing, pump-and-dump schemes or coordinated trading to move a price
• manipulate votes: bots, scripts, multiple identities, vote buying or brigading
• impersonate anyone or publish content you do not have the rights to
• attack, probe, overload or disrupt the interface, its APIs or the program, or scrape them at a rate that harms other users
• get around geographic restrictions, sanctions screening or any security or rate-limiting measure
• use the interface if you are under 18 or in a restricted jurisdiction

11.Third-party services

upvoted relies on services we do not control, including pump.fun and its programs, Solana and its RPC providers, the PumpPortal data feed, IPFS gateways, image and price services, wallet software and our hosting provider. They can fail, change, be slow or be wrong, and they have their own terms. We are not responsible for them or for any loss they cause.

12.Assumption of risk

You understand and accept the risks described in the Risk Disclosure, which is part of these terms. In particular: memecoins are extremely volatile and not stable, most lose all their value, often within minutes, and you can lose everything you put in. You use upvoted entirely at your own risk.

13.No warranties

upvoted, the program and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability and security. We do not warrant that upvoted will be uninterrupted, error-free, secure or free of harmful components, or that any data shown is accurate or current. The program has not been audited.

14.Limitation of liability

To the fullest extent permitted by law, we and our affiliates, contributors, officers and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of earnings, revenue, funds, tokens, data, goodwill or opportunity, arising from or related to upvoted, the program, any token, any transaction, any vote or ranking, or these terms, whatever the legal theory and even if we were told such loss was possible.

To the fullest extent permitted by law, our total liability for all claims is limited to the greater of (a) the fees you paid to us in the twelve months before the claim, which is zero, and (b) one hundred US dollars.

Nothing in these terms limits liability that cannot be limited under the law that applies, such as liability for fraud or, where applicable, for death or personal injury caused by negligence.

15.Indemnity

You agree to defend, indemnify and hold harmless us and our affiliates, contributors, officers and agents from any claim, loss, liability, damage and expense (including reasonable legal fees) arising from your use of upvoted, the coins you launch or promote, the content you publish, your breach of these terms or your breach of any law or third-party right.

16.Changes, suspension and termination

We may change, suspend or discontinue any part of upvoted at any time, including disabling trading, launching or voting, hiding coins, or pausing the program, without notice or liability. We may block access for anyone we believe is breaching these terms or the law.

We may update these terms. The date above shows the latest version. For significant changes we will ask you to tick the boxes at the entrance again. Continuing to use the interface after a change means you accept it.

17.Taxes

You are solely responsible for determining, reporting and paying any taxes that apply to your transactions and holdings.

18.Governing law and disputes

These terms and any dispute arising from them or from upvoted are governed by the laws of the jurisdiction in which the operator is established, without regard to its conflict-of-law rules. To the extent permitted by law, disputes will be resolved individually, not as a plaintiff or class member in any class, collective or representative proceeding.

If you are a consumer, you keep the protection of any mandatory rules of the law of your country of residence that cannot be excluded by agreement.

19.General

If any part of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. These terms, the Privacy Policy, the Risk Disclosure and the Disclaimer are the whole agreement between you and us about the interface. You may not transfer your rights under them; we may transfer ours.
